Definitions
- “Consumer”: A natural person purchasing goods for personal use (not resale).

- “CPA”: Consumer Protection Act, No. 68 of 2008.
- “ECTA”: Electronic Communications and Transactions Act, No. 25 of 2002.
3. Orders & Payment
- Orders are binding once payment is confirmed.
- Prices include VAT and are subject to change without notice.
- Payment methods: Credit/debit cards, EFT, or approved third-party processors (e.g., PayPal).
- We reserve the right to cancel orders suspected of fraud or inaccuracies.
4. Shipping & Delivery
- Delivery times are estimates only. Delays due to couriers or force majeure (e.g., strikes, pandemics) are not our liability.
- Risk passes to you upon delivery. Report damaged/missing items within 48 hours of receipt.
5. Returns, Refunds & Exchanges
- Hygiene Policy: Due to the intimate nature of our products, used Goods cannot be returned or refunded under any circumstances.
- Defective Goods: Unused, defective Goods may be returned within 7 days of delivery. Proof (e.g., photos/video) must be provided.
- CPA Compliance: Returns are subject to Section 20 of the CPA. We reserve the right to repair, replace, or refund defective Goods.

- Intended Use: Goods are designed for personal, adult use only. Misuse (e.g., improper cleaning, modification) voids warranties.
- Health & Safety: Consult a medical professional before use if pregnant, ill, or with sensitive conditions. We are not liable for health issues arising from misuse.
- Age Restriction: By purchasing, you confirm you are 18+. We may request ID verification.
7. Privacy & Data Protection
- Personal data is processed per South Africa’s Protection of Personal Information Act (POPIA), 2013.
- Payment details are encrypted and never stored.
- We do not share/sell your data unless required by law.
8. Dispute Resolution
- Mediation: Disputes will first attempt resolution via mediation per CPA guidelines.
- Jurisdiction: Any legal action falls under South African courts (Western Cape High Court, unless otherwise mandated).
9. Limitation of Liability
- We are not liable for:
- Indirect/consequential damages (e.g., emotional distress).
- Third-party actions (e.g., courier delays, payment processor errors).
- Product misuse or failure to follow instructions.
- Liability is capped at the purchase price of the Goods.
10. Intellectual Property
- All Website content (logos, text, images) is owned by Awgasm. Unauthorized use is prohibited.
11. Amendments
- We may update these T&C at any time. Continued use constitutes acceptance.
